Payment & Cancellation Policy
The owner/agent retains the right and without previous notice
Customers must follow the owner’s security regulations and the ship’s captain’s rules concerning order and safety on board the ship.
The owner and its representatives reserve the right to refuse passage to customers who might pose a threat to the safety of other passengers, themselves or the ship.
The owner, captain and ship’s crew have the right to refuse passage to persons who are under the influence of alcohol or narcotics, who display disturbing or threatening behavior, or who do not otherwise comply with the aforementioned rules concerning security or other regulations.
Children must always be in custody of their parent, legal guardian or any adult appointed by their parents or by their legal guardian.
Cruise departure and return point is Nidri harbour, Lefkada unless otherwise confirmed.
The ship’s schedule must be strictly adhered to. In the event of the customer missing the ship at any of the ports of call listed in the itinerary, the owner/agent shall in no event be liable for such a mishap nor is expected to provide for alternative transportation.
If inclement weather threatens or is forecast to threaten the expected location of the ship on the day of the cruise, as determined by the Captain in his/her sole discretion, the Captain shall have the option of amending, terminating or cancelling the cruise any time that he deems necessary. No warranty is made as to the suitability of weather with respect to a reservation.
The owner/agent will endeavour to cater for any food allergies and dietary requirements that are advised in advance but they cannot be guaranteed.
Safety Regulations
The ship’s safety procedures are certified by the Hellenic Nautical Authorities. According to Hellenic Coast Guard regulations, all required crew and personnel are trained and regularly tested in proficiency in emergency procedures in case of fire, recovery at sea, evacuation procedures, disaster at sea, etc.
The customer is allowed to carry on board as luggage, only such personal effects which usually and reasonably are carried on board for daily cruises of this kind. Birds, dogs or any other pets or animals, cannot be carried along and will not be permitted on board. Passengers carrying dangerous, inflammable and contraband items or explosives will be reported immediately to the proper Public Authority and in any case, the customer who will disregard this warning shall be compelled to reimburse the owner for whatever damage or expenses will result there from.
Documents, manuscripts, jewellery, a substantial amount of money or other valuables of any kind must not be included in customers’ luggage and if they are, no liability whatsoever is assumed by the owner. The owner is in no event, liable for any loss or damage to these items. If the passenger notices the loss of or damage to any of their personal items, immediately after the disembarkation should contact the ships owner/agent at the port.
Passengers agree to the publishing of any of their photos and videos on the boat’s website, social media and blogs, on third-party blogs, in newspapers, magazines and television channels, for advertising purposes. The Captain gives permission and shall allow the passenger to use any photographs in which the Captain and his/her crew appears.
Neither the owner nor the captain shall be liable for any loss of life, or personal injury which may be suffered whenever such events take place before the customer has embarked on board or while is ashore at an intermediate port, or after disembarkation at the final destination port. For such events, taking place on board the ship, the owner shall be responsible only if the interested party will be able to prove that the particular event, was caused by gross negligence of the owner, or his representatives.
Customers participating in the daily cruise do so at their own risk and any complaint, which they might have, should be addressed to local persons who are providing the specific excursion service. The customers undertake the responsibility to indemnify the owning company of the “Daily Cruise” for any damages which the owner or his representatives might sustain, arising from the excursion arrangements, made on his behalf and for the damages the excursion operator might sustain from the passenger.
The Contract – The Contract between the parties is entered into at the time the booking deposit is paid.
Confirmed Booking – The Owner and/or Captain guarantees the availability of the Boat at the date of signing of this contract, for the date set forth in the contract. The booking is confirmed for the dates required once the relevant deposit amount is received.
Deposit and Payment – A deposit of 30% must be paid to confirm the booking. The Balance of the charter fee must be settled in full by bank transfer, to the Captain’s bank account six weeks before the date of the event.
Cancellation Policy – Cancellations of confirmed events must be confirmed in writing or by email. Charges for cancellation prior to the event date through no fault of the Agent or Owner are as follows:
· Cancellations more than six weeks before the event – 30% of the charter fee retained
· Cancellations within six weeks of the event date – 100% of charter fee retained
If the Owner is unable to fulfil the commitment to this Contract, they will only cancel for reasons beyond their control. In such a case the charter fee will be returned to the Client. Any additional costs already incurred for the purpose of the charter will be deducted from the charter fee before it is returned to the client. If for whatever reason the preferred boat is not available, the Organiser or Owner will provide an alternative boat of equivalent quality and category.
Other costs – The charter agreement will confirm in writing what is included, or to be charged extra. Any extra requests are to be confirmed 1 week before the cruise in writing and appended to this contract. Additional food and beverage arrangements other than the onboard snack bar, with details and prices should be agreed in writing.
Number of Passengers – Final number of passengers to be confirmed in writing 7 days before the cruise. A full list of passenger names and nationalities is to be provided to the Captain by the Client or Organiser minimum of 48 hours before the charter date.
Departure port – Cruise departure and return point is Nidri harbour, Lefkada unless otherwise agreed in writing in advance.
Liability - The liability of the Captain extends to all and every loss or damage to the persons and property of the passengers, during the cruise, caused by any actions or omission, his or the ship’s Captain and crew, under this agreement or otherwise. The Client will indemnify The Boat and Captain from all claims, loss or damage affecting the Boat, its employees or third parties caused by the Client, their guests, or agents under this agreement or otherwise. These Terms and Conditions contain the full terms of our contract, and neither party relies on any other documents or oral statements.
Insurance & Licences - The Boat holds the necessary public liability insurance and required licenses as stated by local laws. The Boat also is fully suitable for the Cruise described, and the Boat’s Captain and Crew, of the Captain’s choice and under his full responsibility, are all suitable and licensed to perform the task assigned to them. The Captain is solely responsible for ensuring the crew carry out, and are limited to, standard crew duties such as anchoring, mooring, cleaning, basic boat maintenance.
Force Majeure - The Owner reserves the right to cancel any booking forthwith and without any liability on its part in the event of any damage to Boat by fire, extreme weather, earthquakes or any other cause beyond the control of the Owner and/or Captain.
Delays & Weather Conditions – The Captain shall not be held responsible for the consequences of any delays, whether arising from accidents, breakdowns, airlines not running to schedule, change in weather or any other cause. If inclement weather threatens or is forecast to threaten the expected location of The Boat on the day of the Charter, as determined by the Captain in his/her sole discretion, the Captain shall have the option of amending, terminating or cancelling the charter any time that he deems necessary. No warranty is made as to the suitability of weather with respect to this charter.
Any unforeseen issues occurring during the charter period which could affect the safety of the boat and/or the passengers will be assessed by the Captain and advised to the Client or Organiser. The Captain’s decision on subsequent changes to the route or timings is final.
Authority – The Captain warrants that the Captain and all members of the crew meet all requirements necessary to legally command and work on the boat in the area chartered. It is understood that the Captain is in full command, and that the Client agrees to abide by his judgment as to clearance, sailing, weather conditions, anchorages and other pertinent matters. All members of the Crew, Captain included, are employed by the Owner, and no relation whatsoever, economic or other, connects them to the Organiser or the Client.
Port Authorities – The Captain warrants that the Boat complies with all Greek Port Authority regulations. Life jackets are available on board and are worn at the Clients’ discretion, following the Crew’s instructions. Such instructions will be given also concerning every other matter with regards to the passengers’ safety or conduct. In case of breach of such direct instructions by the passengers, any penalties (issued by the Port Authorities) incurred due to unlawful activity against such instructions, or delays and through no fault of the Captain will be borne by the Client.
Damage and conduct - Guests are expected to take reasonable and proper care of the boat and its furniture and fittings. The Client will not normally be charged for minor breakages however, in entering the Contract the Client is agreeing to pay for any damage to the boat, which could have been avoided, provided such damage is detected, pointed out and agreed upon, before the departure of the Client’s guests from the boat. The Client accepts responsibility for the proper conduct of any members of its’ party. The Captain cannot be held responsible for under-age consumption of alcohol. The Captain reserves the right in his absolute discretion to terminate without further notice the charter if any client and/or guest of the client who refuses to comply with the reasonable instructions or orders of the company staff, crew or other responsible person whose behaviour in their opinion is likely to cause distress, damage, danger or annoyance to other Clients, staff, any third party or to property.
Passengers – The maximum number of passengers on board must be strictly adhered to. If any of the party are under the age of 18 they must be under the supervision of a responsible parent or guardian at all times throughout the charter period. It is against the law to serve alcoholic drinks to anyone under the age of 18 and the Captain reserves the right to ask guests of the Client for valid proof of age identification.
Catering and bar service – The provision of food and beverages must be agreed in writing at least 2 weeks before the charter date. Only food and beverages provided by the Captain may be consumed on board or during the charter period. Prices for food and drink will be provided to the Client in advance, these may be subject to minor variation. Any charges incurred (e.g. bar tabs) must be settled within 48 hours of the end of the charter period.
Food Allergies and Dietary requirements - The Captain will endeavour to cater for any food allergies and dietary requirements that are advised in advance but they cannot be guaranteed.
Drugs and Other Illegal Activities – The use, transportation, or possession of illegal drugs or narcotics (including marijuana) or of any other contraband, or the participation in any other unlawful activity is strictly prohibited. The participation in any of these activities by the Client, or by any guest of the party constitutes a breach of the charter and shall be cause for immediate termination of this Agreement without refund of any payments made by the Client.
Release Statement - The Client agrees to the publishing of any of their photos and videos on the charter boat’s website, social media and blogs, on third-party blogs, in newspapers, magazines and television channels, for advertising purposes. The Captain gives permission and shall allow the Clients to use any photographs in which the Captain and his/her crew appears.
Complaints - Any complaints as regards to the Boat should be made to the Owner or the Captain or the Crew as soon as they arise. No complaints will be entertained after the event date, or after the guests have departed.
